COVID 19 Emergency Legislation

The purpose of this guide is to provide links to Alberta and Federal emergency legislation, in response to the COVID-19 pandemic. This guide will be updated on a regular basis to reflect new and amended legislation.

Alberta

As per OC 80/2020, OC 354/2020, and OC 255/2021 the Lieutenant Governor in Council declared a state of public health emergency in Alberta due to pandemic COVID-19 and the significant likelihood of pandemic influenza. 

Under the authority of the Public Health Act, the Chief Medical Officer of Health (CMOH) has issued Public Health Orders (and Exemptions) that Albertans are legally required to follow.

Ministerial Orders issued in response to the COVID-19 pandemic – Under the Public Health Act, a Minister is authorized to make an order without consultation, suspend or modify the application or operation of all or part of an enactment for which that Minister is responsible subject to the terms and conditions that Minister may prescribe if the Minister is satisfied that its application or operation may directly or indirectly unreasonably hinder or delay action required in order to protect the public health.

Alberta Government: COVID-19 info for Albertans

Federal

The Government of Canada has the authority, under existing laws, such as the Quarantine Act and the Aeronautics Act to issue orders and regulations to address COVID-19 to ensure the public safety of Canadians.
